Idiot Alert Dennis Windsor Defamatory Negative Feedback

Avoid This Unknowledgeable Buyer
Fortunately most of our customers, both eBay and non eBay customers, are reasonable people.
However in common with all businesses, we come across a small percentage, perhaps only 1 or 2%, who are unreasonable, stupid, paranoid, delusional, or possibly suffering from the temporary or permanent effects of substance abuse.
When it comes to direct (i.e. non-eBay) customers, our normal practice is to politely encourage them to shop elsewhere. Most of the time, they either do this, or become reasonable.
Via eBay, it is a little more difficult to avoid these customers from hell. Sure we could set a minimum feedback level, but we started at zero ourselves, and we decided not to restrict buyers. It is also easy for scammers and conmen to set up multiple accounts, and acquire an instant positive rating by buying numerous 1 cent or 1 penny items. Even a 100+ feedback does not guarantee that an eBay member is OK, as this example shows.

We have been in the coin business as professionals for over 42 years. Everything we sell carries an absolute guarantee that it is genuine (unless specifically and clearly described otherwise), and as described. We are founder members of the BNTA, the UK equivalent of the ANA, and adhere to a strict code of ethics. Our annual sales exceed $10 million.
The coins offered in the eBay listing you refer to are genuine.
How you can profess to state that they are not genuine, or are suspect, from your armchair in California, 5,000 miles away from us, we do not know. We suggest that if you do not know what you are talking about, then keep your mouth shut. At least you could go back to asking questions instead of making statements.
We would also advise you either not to bid on items unless and until you have read the item description, and satisfied yourself that the seller is bona fide. If you are not completely certain, then do not bid. In addition, if you do bid, and win the item, do not fail to pay, and certainly as an NPB Non Paying Bidder, do not post false misleading and defamatory feedback.

Interestingly, although the seller appears to be quite reputable, it is not described anywhere in the listing as such.

Good Example

These coins are interesting for a number of reasons.
The first thing to note about these coins is that they were not struck in 1915, but have been issued ever since, as an official restrike by the Austrian Mint. Austria has a tradition of issuing commemorative coins after the death of an emperor, with the date frozen.
In a similar tradition is the silver Franz Joseph thaler dated 1780, we have seen many of these coins bought and sold on flea markets and car boot sales at quite high prices, bought by greedy people who thought that they were going to make a quick vast profit, and sold by less-than-honest sellers, who knew the truth! We also frequently see them for sale on eBay, also without being described as restrikes, a practice with which we disagree strongly.
We also receive hundreds of e-mails and telephone calls every year from people demanding to know their value.
We are offering an Austrian 1 Ducat gold official restrike coin in uncirculated (mint) condition.

Although we would not seek to pillory your seller for his omission (he may not know), if you stuck to using reputable, professional, knowledgeable vendors like us, you would get a more accurately described item. However, it is unlikely that many other reputable dealers will wish to deal with you, considering your ill-judged actions and comments.
We may publish your original e-mail to us, or some of the others. If anybody reading this guide is in any need of convincing, this would do the job!

Remedies
We can ask eBay nicely to remove this defamatory comment, but they, rather unfairly in our opinion, require each request to be
countersigned by a solicitor, which costs time and money. Actually we did ask our "Platinum Powerseller Personal Support Manager" to get it removed, but he pointed us to their defamation removal page:

Sue?
We could sue the member, and eBay for defamation. In this case, it is almost beyond doubt that we would win, and be awarded damages and costs. The main problem with this is that it tends to cost  megabucks (think $/£100,000+ in legal fees) to run a libel action. If the other party cannot pay, because they have no money, then the litigant ends up paying. Obviously eBay have plenty of money, so we would get something from them, but it still makes a lot of work to prepare a case, instruct solicitors, and fund the case until completion. It is like sitting down to play poker against an opponent with 100 or 1,000 times your stack of chips. It also seems a bit off that eBay reqire us in the UK to write to eBay in Australia about a member in California USA, but then eBay do some weird things. Could this be one of their ways to make it so much harder for people to pursue genuine complaints against them?

I am buying a set of seven full British Sovereign coins comprised of
approximately 25% pure gold. These coins are of the same value as
any other real, minted gold Sovereigns as by The Royal Mint. I
would have to have insurance which I will pay for. The shipping
need not be expidited and before inusurance charges shipping is
twelvw dollars USD. All Ebay rules, covenants and restrictions
apply. Seller warrants seller has no leins against said coins and may
legally into this binding contract. These notes cover our sales
agreement whuch is bound by the laws of the Great State of
California. This agreement is not limited to anything not heretofore
mentioned but any favor falls to the buyer (denniswindsor a/k/a
Dennis Purcell) who will pay for the coins with a credit card. Seller
will contact buyer stipulating agreement. Buyer plans to pay by
Paypal. Should seller have mis-warranted goods he will issue a
credit for the full amount including shipping and insurance fees. I

Our Comment                       
This is just one example of the type of customer we occasionaly get on eBay. We are disappointed that eBay are so reluctant to take any action against such members, and that their systems are so flaky in the first place that they permit thier own reputable members to be defamed in such a manner, without easy recourse.
